Toronto Bail Hearing Lawyer – Neil Singh

When a person is arrested and charged with a criminal offence, the first and foremost concern is to ensure that person is released from custody.

It is clear that your chances for success in a case are greatly increased if you are out of custody while awaiting your trial.  It is easier for you to get information that will assist your case. The stress you feel will be greatly alleviated. It goes without saying: it is better to be out of custody than to be in.

If you or a loved one has been arrested and charged, call Neil Singh

1 Initial Interview – Sometimes, the police will contact you to advise you they want you to come to the police station for “questioning” or to turn yourself in.  If the police have contacted you, it is important to contact a lawyer to ensure your affairs are in order.  First, we can assist you with techniques to avoid an ambush by the police when you attend the station.  Secondly, we will conduct a comprehensive interview to ensure that we are prepared to ensure you release from the police station.

2 Police Negotiation – Our contact with the police will occur after our initial interview or after we receive a call informing us that you have been arrested.  Neil Singh will contact the police officer in charge of the investigation directly.   We will determine what your charges are, what the alleged facts are, and what evidence the police have to support the charges.  We will also start negotiating with the police officer.  Often times, Neil Singh is able negotiate your release from the station with the officer.  If the police decide to hold you for a bail hearing, Neil will speak to the officer to determine why the police want to hold you for a bail hearing.  Through this discussion, we are able to determine the police officer’s concerns regarding your case, and formulate a release plan to specifically address them.

3 Surety – During our initial contact we will get the contact information of potential sureties who may be able to post bail for you.  Once it has been determined that you will be brought to Court for a bail hearing we will interview and prepare your sureties for the bail hearing.  We will conduct a comprehensive interview with your sureties, prepare them to testify, and in particular, prepare them for a rigorous cross-examination from the Crown Attorney.

4 The Bail Hearing – The next day at Court, Neil will attend and negotiate with the Crown Attorney.  In many cases, your release can be negotiated with the Crown Attorney.  By determining beforehand what the concerns are through the arresting officer, we will be in a position to approach the Crown with a plan of release that will likely satisfy their concerns.  The goal is to get the crown to agree to release you without the need of a contested bail hearing.  However, if the Crown Attorney is of the view that a contested bail hearing is required, Neil will be prepared to fight for your release.  We will present a comprehensive and thorough release plan to the Court.  Your release from custody is the greatest priority.

Neil has an excellent track record of securing his clients’ release from custody.  With his thorough and comprehensive approach, you will be in an excellent position to be released from custody when you work with Neil.  If you or a loved one has been arrested, contact our office to speak directly with Neil Singh.
